terms of use

last updated 26 july 2026 · effective 26 july 2026

these terms are the agreement between you and habeat for using the app. they're written plainly, but they are a contract — please read them. by downloading or using habeat, you agree to them.

contents

acceptance

by downloading, installing, or using habeat, you agree to these terms of use and to our privacy policy. if you don't agree, please don't use the app. you must be at least 13 years old (or the minimum age of digital consent in your country) to use habeat.

your licence to use habeat

we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use habeat on apple-branded devices that you own or control, as permitted by the app store terms of service. this licence is for your own personal, non-commercial use. you may not copy, modify, reverse-engineer, decompile, redistribute, rent, or resell the app except where the law expressly allows it.

the free tier

habeat is free to download and use with up to three habits, with no time limit and no payment required. core daily use — creating habits, holding them, building streaks, and earning a theme's colour — is included at no cost.

premium & subscriptions

habeat premium lifts the two limits on the free tier: it unlocks unlimited habits and the full ten-theme vibe library. everything else in habeat — iCloud sync, reminders, the widget, on-device summaries and CSV export — is included for free users too. premium is offered as:

  • a monthly auto-renewing subscription;
  • a yearly auto-renewing subscription; or
  • a one-time lifetime purchase.

prices are shown in the app before you buy and may vary by region and over time. all purchases are processed by apple through your apple id. current pricing is summarised on our pricing section, but the price you'll pay is always the one shown at checkout.

auto-renewal & cancellation

for auto-renewing subscriptions:

  • payment is charged to your apple id at confirmation of purchase;
  • the subscription automatically renews for the same period unless you turn off auto-renew at least 24 hours before the end of the current period;
  • your apple id is charged for renewal within 24 hours before the end of the current period, at the then-current price;
  • you can manage or cancel anytime in settings → [your name] → subscriptions on your device;
  • cancelling stops the next renewal; the current paid period continues until it ends.

the one-time lifetime purchase does not auto-renew. uninstalling the app does not cancel a subscription — manage it in your apple id settings.

refunds

because purchases are handled by apple, refunds are governed by apple's policies and are requested through apple, not habeat. you can request a refund at reportaproblem.apple.com. where the law gives you a statutory right to cancel or refund, that right still applies.

acceptable use

please use habeat lawfully and as intended. don't attempt to break, overload, or circumvent the app's protections, don't use it to violate anyone's rights, and don't try to access features you haven't purchased through unauthorised means.

your content

the habits, names, notes, and history you create are yours. they're stored on your device and mirrored to your own private iCloud, as described in our privacy policy. we don't claim ownership of your content and we can't access it. you're responsible for what you create and for keeping your own backups.

intellectual property

the habeat name, the painted “h” mark, the app's design, the vibe themes, the illustration set, copy, and software are owned by habeat and protected by intellectual-property laws. these terms don't transfer any of those rights to you beyond the licence to use the app described above.

apple's role

this agreement is between you and habeat only, not with apple. apple is not responsible for the app or its content. to the extent there is any conflict between these terms and apple's licensed application end user license agreement, that apple agreement governs the underlying app-store licence. apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. any maintenance, support, warranty, product-liability, or legal-compliance claims relating to the app are our responsibility, not apple's, as set out in apple's standard EULA.

disclaimer of warranties

habeat is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law. we don't warrant that the app will be uninterrupted, error-free, or that it will meet every expectation. habeat supports your practice — it isn't medical, psychological, or professional advice.

limitation of liability

to the fullest extent permitted by law, habeat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or habits, arising from your use of or inability to use the app. where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim. some jurisdictions don't allow certain limitations, so parts of this section may not apply to you, and nothing here limits rights that can't be limited by law.

termination

you may stop using habeat and delete the app at any time. we may suspend or end the licence if you materially breach these terms. on termination, the licence ends, but the sections that by their nature should survive — intellectual property, disclaimers, limitation of liability, and governing law — continue to apply.

governing law

these terms are governed by the laws of the jurisdiction in which the habeat developer is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection laws of your country of residence. disputes will be handled by the courts competent for that jurisdiction, unless local law gives you the right to bring a claim where you live.

changes to these terms

we may update these terms as habeat evolves. we'll post the revised version here and update the “last updated” date. if a change is material, we'll make it clear before it takes effect. continuing to use habeat after an update means you accept the revised terms.
